Fraud Claims Against Coke DismissedWrongful termination suit to continue to go forward.
> > Fulton County Superior Court Judge Elizabeth Long has dismissed several fraud claims made against The Coca-Cola Co., but the claims of wrongful termination will go forward in the suit.
Long dismissed the fraud claims made by Matthew Whitley because he failed to show he was a target of the alledged fraud or was directly injured by it. Long said she will allow Whitley to pursue his claims that Coke inflicted emotional distress on him by pressuring him to participate in illegal activities and fired him when he refused.
Whitley was director of finance for supply management at the Coke fountain unit when he was fired in March. Whitley accused the company of manipulating a market test by Burger King Corp., overstating revenue and profit, using slush funds to hide losses from the company computerized fountain drink dispensing system, selling frozen drinks that contained metal residue and discrimination against African-American and Hispanic employees. Coca-Cola will spend roughly $21 million to mend fences with Burger King. Source: Atlanta Business Chronicle
